Riyadh Arab Agreement For Judicial Cooperation

The Parties shall be responsible for coordinating the requests for extradition provided for in this Agreement with the Arab Criminal Police Bureau through the relevant liaison offices, in accordance with the Agreement establishing the Organization; the party requesting extradition shall transmit to the Office a copy of the extradition decision. The functions of the competent judicial body of the Contracting Party to seek recognition or enforcement of the judgment in question shall be limited to determining that the judgment complies with the provisions of this Agreement without examining the subject matter of this Agreement; the affected body does so automatically and confirms the result in its relevant decision. The provisions of the preceding articles shall not affect the right of citizens of one of the Parties residing in the territory of another Party to publish all judicial and extrajudicial documents and documents in civil, commercial, administrative or personal matters or to transmit to persons residing in that territory. Visits by judicial delegations and exchanges of members of the judicial system and other experts to follow legislative and judicial developments are encouraged by the parties, as well as exchanges of views on legal issues and study visits by the personnel of each State. (c) where the contractual obligation which is the subject of the dispute has been fulfilled or is binding in the Contracting Party, on the legal basis or on discharge, by an explicit or tacit agreement between the applicant and the defendant. In accordance with the provisions of this Agreement, the Party invited to set up such a mutual legal assistance commission shall be obliged to do so and may refuse the execution of such requests only in the following cases: the immunity of the witness or expert shall expire after thirty days from the date on which the judicial bodies of the requesting Party renounce their presence in the territory of the requesting Party, unless there are grounds for checking the person, to prevent his departure – or if he voluntarily returns to this area after his departure. The publication or service of judicial or extrajudicial documents or documents does not allow the requested authority to pay the costs or expenses incurred. Without prejudice to the provisions of specific articles relating to the extradition of persons accused of having committed or convicted a criminal offence, judicial and extrajudicial documents and documents relating to criminal cases shall be sent directly through the Ministry of Justice of each Party. Procedures implemented by a mutual legal assistance commission in accordance with the provisions of this Agreement shall have the same legal effect as if they were conducted before the competent body of the requesting Party. .
